Don't I have the right to repair


Hi. all that read this,

I've been contacting for over 20 yrs and this is the first time this has ever happened to me. If anyone else has had this same or similar issue I'm about to tell you about, please comment on your situation and what you did to resolve the problem. It just blows me away that some people think that they can lie cheat & steal and get away with it.

Anyways this guy back charged me for the last couple jobs I did for him for deficiencies. He said he had someone come in and skim and sand my work after I was done , and deducted it of my invoices owing. I did skim and sand to finish the one job 3800sq.ft. and he asked me not to finish the 1400sq.ft. I was working on, stage of finishing. Not sure why he asked me to stop. I asked him and he said the customer did not want me to finish it. I thought that was strange, I got along with them and the day before at the end of the day I told the customer that I would be back to finish off the job tomorrow and he had nothing to say to me not coming back and said see you tomorrow cheers!

Anyways this guy takes 25% off the 3800sq.ft. job and 30% of the 1400sq ft. job plus and extra $500 for his travel expenses and cut the check for the difference. I bought all the material and drove more then 20 hrs. to do this jobs. After all my expenses it leaves me with 500 bucks.

The question is if I did not do the job to his satisfaction, does he not have to contact me first to repair my work and then if I don't resolve his issues in a timely manner he then has the rights to call in someone to finish the unfinished work?

If this is the case should I take this guy to court and or lien the 2 homes till I receive my full amount owing to me?

Feeling ripped off!

I had a HO recently flip out on me when he saw dark spots that were still wet seeings how he left the heat down on 62 after I said to jack it to 85 because it was -5 outside. He called the cops and had me escorted out of his house.
Later I found out his ex-girlfriend said she got horny and did me while he was at work just to try to make him jealous. I'm now liening his property and will get my money at court. I also lost all my materials, mud prime and paint.

I'd resubmit your bill to him and tell him he must give you 48 hours to make it right before he can back charge you for it. Sorry for your loss but make sure you have a clear and detailed contract next time. I too will never be taken advantage of again!

He shouldn't just back charge you... I have never seen your work though, maybe he was confident that you would never be able to fix it...

But there are plenty of "builders" out there that, what I would call, embezzle from subs that they think they can get away with it on.

I just talk to him on the phone, calling him with a number he does not know, because he never picks up when I called from my personal number. That goes to show, he is just avoiding me.

Well I asked him to explain why he deducted such a high % off my invoices and the first thing he start getting angry saying he did not want to talk to me and stopped for a second and then finally saying I destroyed the job like he just thought up what to say at the moment. He hesitated, he choked up when I asked him how, and he could only say those 4 words "I destroyed the job" and I have to go I'm with a customer and hung up.

Why could he not simply explain the details of what was wrong with my job in the first place. All the other jobs I did for the guy were not a problem just this last 2 jobs. How ignorant can a person be? I remember what I do and how it turned out and don't forget what I did. This guy talk to me like I don't remember what I do or something, or he has the problem himself and thinks everyone does too. His brain must be fried. I had a funny feeling about this guy at the beginning. I think he is on some kind of heavy drugs, or was, just the way he talked, swearing and saying man all the time.

This guy simply is a lying conniving theft period and he's lucky I don't post who he is and make it public.

Throw the lein on. You cannot talk sense into people like that. Let the court decide. Most of the time people will just eat it and never work for the dude again. Thats a win for the contractor. Put the screws to him.

There are some many F'n crooks out there, last year was the worst year for me. I swear, I hope Karma attacks these people back! So many crooks! -

Used to be about 1 in 10 or 20 would pull some stuff like this. Now thanks to media spin,lawyer commercials and Bob Villa type shows it seems like nearly everyone is looking for a minor detail to withhold payment. My family and I are currently waiting for eviction(illegal at that) thanks to these tactics and to contractors who have cut prices back to cracker box pay for super custom work.

I had an experience with a contractor twice now the first time was several years ago when i did some follow up repair behind another taper , I don't know If he expected me to do it for free but he said it wouldn't happen again i said you are right find some one else to do you work if you are going to grip about it all said and done, i didn't work for him for years after that even though he wanted me too . Later about 3 years he called me up and i thought what the heck i will give him ago well after 3 more years and about 30 homes which i never once had a call back for repairs the painter decided to back-charge me on 2 homes for $1600.00 of coarse i tried to contact the painter which never returned my calls , i went out to see what repairs he had done i was baffled , i told the contractor i would give him back the money if i see and invoice as to what the painter had done for that kinda money , never did see on (scammer) the contractor just gave me a bill for the amount , I explained to him i don't bid high enough to pay the painter , he said know one bids that high , i replied after i gave him a check to never contact me again to do work for free .... needless to say i have had the last laugh he is no longer in business..... If you feel that you deserve more payment file a lien against him , the property , and the homeowners , what right is right . I hope you have a contract which sometimes don,t matter , find out if an abstract company is handling it , they can put extreme pressure on them , also contact the homeowners themselves , overstep the contractor since he is trying to pocket money on your expense.

Always have a contract..ALWAYS, and if they have a problem paying, and you have paid for materials..take it off the wall, comes off nice and easy with a 6" knife
